1. Acceptance of Terms

By installing, accessing, or using Swoop ("the Extension", "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Extension.

2. Description of Service

Swoop is a Chrome Extension that provides screen recording and video editing capabilities directly in your browser. The Extension offers both free features and premium features available through a one-time Pro upgrade purchase.

3. Free vs. Pro Features

Free tier: Includes screen recording, basic editing (trim, cut, zoom), background styling, browser frame overlays, and export up to 1080p with a "Made with Swoop" watermark.
Pro tier: Unlocks all features including 4K export, AI captions, neural silence detection, cursor effects, custom branding, privacy tools, and watermark-free exports. Pro is a one-time purchase — no recurring fees.

4. License Grant

Upon purchasing Swoop Pro, you are granted a personal, non-transferable, non-exclusive license to use the Pro features of the Extension. This license:

Is valid for one individual user
May be activated on multiple devices belonging to the same user
Permits both personal and commercial use of videos created with Swoop
Does not permit redistribution, resale, or sharing of the license key

5. Payment & Pricing

All payments are processed securely through Gumroad, our payment provider.
Prices are listed in USD and may be adjusted at our discretion. Price changes do not affect existing license holders.
Launch pricing ("Early Adopter" rates) may be limited in quantity or time and can be discontinued without notice.

6. Refund Policy

We offer a 30-day money-back guarantee for Swoop Pro purchases. If you are not satisfied for any reason, contact us at help@swoop.video within 30 days of purchase for a full refund.

After 30 days, refunds are handled at our discretion on a case-by-case basis.

7. Intellectual Property

The Swoop Extension, its source code, design, and branding are the intellectual property of Swoop Video.
You retain full ownership and rights to any videos, recordings, or content you create using Swoop.
You may not reverse-engineer, decompile, or distribute the Extension's source code.

8. User Responsibilities

You agree to:

Use the Extension in compliance with all applicable laws
Not use the Extension to record content without proper authorization or consent
Not share, resell, or distribute your Pro license key
Not attempt to circumvent any licensing restrictions

9. Data & Privacy

Your use of Swoop is also governed by our Privacy Policy. In summary: all data is processed locally, we do not collect personal data, and your recordings never leave your device.

10. Disclaimers

The Extension is provided "as is" without warranties of any kind, express or implied. We do not guarantee:

Uninterrupted or error-free operation
Compatibility with all systems, browsers, or browser versions
That all features will be available on all hardware configurations

11. Limitation of Liability

To the maximum extent permitted by law, Swoop Video shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, recordings, or revenue, arising from the use or inability to use the Extension.

12. Updates & Modifications

We may update the Extension and these Terms from time to time. Continued use of the Extension after changes constitutes acceptance of the modified Terms. Pro license holders receive updates to the version they purchased (V1 lifetime updates).

13. Termination

We reserve the right to revoke a Pro license if the user violates these Terms, including but not limited to redistributing the Extension or sharing license keys. In such cases, no refund will be issued.

14. Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes shall be resolved through good-faith negotiation before pursuing formal legal action.
